A seaman from Iberia Parish, Louisiana resident has filed a Jones Act lawsuit against his former employer for a brain injury he sustained while working at sea.
Burleigh J. Hebert II has filed suit against Estis Well Service on Oct. 28 in federal court in New Orleans for an injury that occurred on Oct. 28, 2009. Hebert was working aboard the EWS Rig. No. 69 in Mosquito Bay in Terrebonne Parish when a high pressure hose separated from a valve and struck the seaman in the head.
Hebert sustained serious injuries including a fractured skull and brain damage.
Estis Well Service is accused of negligence for failing to properly secure the high pressure hose to the choke valve using a hobble device or other equipment that would prevent the hose from separating from the valve and causing injury. The company is also accused of failure to properly equip the vessel with appropriate devices, failure to provide a safe place to work, failure to properly inspect, repair and maintain the vessel , failure to remedy unreasonably dangerous conditions, failure to warn of dangerous conditions, failure to supply a sufficient number of competent and trained personnel, failure to properly train the crewman for the job being performed, failure to comply with customary industry regulations, and failure to provide a seaworthy vessel.
Herbert is seeking compensation for his physical pain and suffering, mental pain, suffering and anguish, disfigurement, medical costs, lost wages, lost future earning capacity, loss of fringe benefits, loss of enjoyment of life, maintenance, cure, interest and court costs.
