A seaman has filed suit against his employers for injuries sustained when workers panicked following an explosion caused by a fire extinguisher aboard the F/V Floatel One.
The incident occurred on September 17, 2010. Garibaldi Encarnacion and other workers on the vessel were assigned to attend a safety meeting. Ironically, during the safety meeting a fire extinguisher on the vessel became detached from its fixture and fell on the deck. The extinguisher exploded.
The workers panicked. During the panic, Encarnacion was thrown against the wall and fixtures in the meeting room.
Encarnacion has filed a Jones Act lawsuit against BP Exploration and Production Inc., Stallion Offshore Quarters Inc. and Southern Environmental of Louisiana. The paperwork was filed on Nov. 16 in New Orleans federal court.
Encarnacion is seeking monetary compensation for his physical pain and suffering, mental pain, suffering and anguish, medical expenses, lost wages, lost found, loss of future earning capacity, loss of future found, loss of fringe benefits, disfigurement and disability, loss of enjoyment of life, interest, court costs and attorney's fees.
The defendants are accused of negligence for failure to provide a competent crew, failure to properly supervise their employees, failure to properly train and supervise the plaintiff and other employees, failure to provide the plaintiff with a safe place to work and for requiring the plaintiff to work in unsafe conditions, failure to provide adequate emergency procedures and evacuation plans and failure to properly train persons aboard the vessel in proper emergency procedures and evacuation plans.
