Who Can File A Claim Arising Out Of The Oil Spill?

Under the law the corporations responsible for the rig explosion and oil spill will ultimately be required to pay any damages which any business or individual legally suffered due to the oil spill. 'Legally caused' means the damages more likely than not were related to the spill; 51% of the evidence must support the claim-- if more evidence than not shows the damages were related to the spill, then such damages should be recoverable.

The people and businesses who may suffer such damages include people and businesses with the direct oil related damages such as property contamination and associated cleanup costs and direct business income losses. However, the law also allows for “indirect” damages as long as they can be proven to be “more likely than not” caused by the oil spill. Literally thousands of businesses and individuals may suffer these types of broader damages.

A partial list may include fishermen, water related businesses including boat marinas, boat rentals, and related businesses, hotels, restaurants, gas stations, rentals condominiums and houses, shops, bars, stores and a variety of other businesses on or near the coastline that count on tourism for their businesses (obviously all forms of businesses near the coastline).
