When Maritime Law Applies to Your Case (Part B)

If you've been injured off the shore of Louisiana or Mississippi, a maritime accident attorney may be able to help you by suing for emotional distress and injury damages you suffered. If negligence played a role in the accident that caused your injuries, you could be eligible for compensation to cover your medical expenses, lost wages and any other ramifications that can be traced back to the accident.

Benefits of Maritime Law

Determining what laws apply to the accident that caused your injuries is vital to the process. If you were injured in navigable waters, you likely have a claim under general maritime law. In general, these laws apply to anyone who is injured in navigable waters.

For instance, if you were a passenger on board a ship and there was an accident serious enough to call the Coast Guard, maritime law would apply to you if you were injured. For the purposes of an employee, if negligence played a role in your injury, then general maritime law grants you maintenance and cure benefits until you recover.

Under maritime law, you may also file for punitive damages
, which are generally intended to act as an incentive to dissuade the company found at fault for negligence from cutting corners and making similar mistakes in the future. Punitive damages are generally only awarded in cases of extreme and overt negligence, however.

If you qualify as a Jones Act seaman - meaning you spend at least 30% of more of your time aboard a vessel - then you are eligible to file both a general maritime and a Jones Act claim. It can be complicated to manage both, so it's highly recommended that you speak with an attorney who can represent you in your Louisiana or Mississippi maritime accident case while you are suing for emotional distress or injury damages.
