The Jones Act When a Diver is Injured on the Job (Part A)

Many people who earn their living as divers are classified as Jones Act seamen, which means they're protected by The Jones Act, a federal law. This law allows seamen who have been injured in a horrific diving accident to directly sue their vessel owners and employers. If you or a loved one has been involved in such an accident, you should make it a priority to meet with a Jones Act attorney.

Some Common Causes of Diving Injuries

A horrific diving accident can be life-altering for a seaman and his or her family, yet many of these kinds of accidents can easily be prevented. When mandatory policies, procedures, and regulations handed down by the U.S. Coast Guard aren't followed, divers pay the price.

Some of the most common causes of diving accidents include:

  • operating outside the dive table limits;
  • defective diving equipment;
  • poorly trained crew;
  • explosions and electrical shocks;
  • improper or inaccurate compression tables;
  • differential pressure dangers;
  • using the wrong gas mixtures; and
  • a lack of sufficient man power.

A commercial accident can lead to a gas embolism, decompression sickness, disfigurement, burns and death.

Through a lawsuit, you may be able to seek compensation for your current and future medical bills, physical and emotional pain and suffering, lost wages, and any other incidental expenses related to your injury; however, before you can recover compensation, it must be proven that the vessel owner, crewmembers or officers, or operators were negligent, and that their negligence contributed to your injuries.

You'll also have grounds for a lawsuit if it can be proven that the vessel was defective in any manner. Because it can be very difficult to prove negligence, it would be in your best interest to contact a Jones Act attorney as soon after your accident as possible. An experienced attorney will be capable of gathering the necessary evidence to build a strong case on your behalf in defense of The Jones. Act.
