In What State Should My Oil Spill Claim Be Filed?

It is our belief that all claims, oil spill and injury related, arising out of the DEEPWATER HORIZON accident will ultimately need to be filed in federal court in New Orleans, Louisiana. We believe this for several reasons.

First, one of the first personal injury suits was filed in New Orleans Federal Court the morning after the rig explosion. In federal court often the court in which a first suit is filed can be significant for determining where other suits will ultimately be consolidated and transferred to for handling by a single judge.

Also, one of the first environmental claims arising out of the anticipated oil spill affecting the coastline was filed in the same New Orleans Federal Court. Again, this increases the likelihood that the New Orleans Federal Court will ultimately take control of all cases.

Finally, the location of New Orleans makes sense as a convenient, proper location for all claims, a factor which is often considered by the courts in determining where to consolidate cases.

For all of the above reasons, we believe that all oil spill claims will ultimately be required to be filed in federal court in New Orleans, Louisiana. If this is correct, then no matter where you file your oil spill claim (Louisiana, Mississippi, Alabama or Florida), it will ultimately be transferred to New Orleans and consolidated with all of the other claims arising out of the DEEPWATER HORIZON accident. This would allow a single judge to take control of the case which is most common in situations such as the DEEPWATER HORIZON accident.
