Oil Spill damages can be proven in a variety of ways.In the case of economic losses associated with lost business income, typically tax returns and other income records from previous years can be used.However, losses can also be proven with expert testimony regarding the downturn caused by the spill.
In the case of commercial fishermen, records (if available) of prior years income could serve as a starting point.In the cases where written records are not available, expert witnesses may also be called to establish the amount of income that would have been generated during this fishing season by a particular vessel.
In the case of small businesses along the coastline, again a comparison of last year’s income during this same time period may serve as a basis to prove lost income this year.
