Seeking an Attorney in New Orleans to Prove You’re a Seaman under Jones Act (Part A)

When you have been injured in a maritime accident, know your rights. Contact an attorney in New Orleans to file your claim under the Jones Act to get the insurance coverage you need and deserve when you are facing the consequences of serious maritime injuries.

Proving you Are a Seaman under the Jones Act Law

In order to obtain compensation to treat and overcome your injuries, you must first prove that you meet the qualifications of being a seaman:

  • 30% of your time must be spent aboard a vessel in navigable waters;
  • you must be assigned to a vessel or fleet; and
  • the vessel or fleet you are working on must be in navigation.

To be identified as a seaman and to be able to collect Jones Act insurance coverage, you must meet all 3 qualifications. Lacking any one of the above qualifications could negate your Jones Act case.

Unfortunately, although it may seem obvious that you worked as a seaman, if you pursue compensation from your employer then they may try to use legal jargon and technicalities to disprove your claim.

Under some circumstances, it can be difficult to prove that you meet the criteria of being labeled a seaman, such as proving that you spent 30% of your time on a vessel.

In some cases, this will be fairly easy to confirm, such as if you are a captain of a ship; however, if you are not, you may be spending your time sporadically on board a vessel, making it more complicated to calculate your time.

That is
why it is often advised to hire an attorney. The Young Law Firm specializes in Jones Act cases and will take on any case from around the country. When you need help filing a claim to collect compensation, after you have been injured in a maritime accident, you know where to look.
