The 3 Types of Employment-Related Payments after a Maritime Injury

A serious maritime accident may keep you out of work for weeks, even months, as you recover from your injuries. During this time, you may lose out on income that's necessary for you to keep up with your daily needs. Your settlement for your Jones Act injury claim needs to reflect these losses and compensate for them.

There are 3 main types of employment-related payments a typical maritime worker may receive: wages, maintenance and cure:

  • Wages are the normal hourly or salary payments you receive as per your employment agreement;
  • Maintenance is a daily stipend you are entitled to if you are not offshore where regular needs like lodging and meals are not provided; and
  • Cure is payment for the medical expenses and treatment available after the accident.

As an injured maritime worker, you may be entitled to include all 3 of these employment-related payments as part of your settlement.

If you feel your employer is not upholding your rights to compensation under the Jones Act, you should speak with a New Orleans maritime injury attorney.
Your attorney can assist you in estimating the value of your Jones Act claim and provide guidance in reviewing and accepting a settlement that fairly compensates you for your losses.
