Maritime Law May Not Apply to Platform Worker Injury

An offshore injury claim becomes more complicated when the accident takes place on an offshore platform. While you are technically offshore, you are on a fixed platform, which in some cases will result in state laws trumping the maritime law.

Generally a platform is governed by the land laws of the state in which it is located.
This determination is often a difficult one to make and relies on registration and licensing of the platform.

Once these things are determined, then there becomes the argument of whether you are considered an offshore worker protected under maritime law or Jones Act Law. Alternately, you may have to file a claim within state land laws.

A maritime law attorney should have several past cases they can use to determine the best course of action to take in your claim.
There are many ways to deal with a platform accident injury, and knowing all the potential methods of seeking compensation is important to your future.

Your maritime law attorney in New Orleans will be of great help when determining when maritime law applies to your offshore accident claim. When filing your claim, the insurance companies and your employer will not offer you any guidance, and if you don't know the full extent of the damages you can claim, you may be missing out on a fair settlement.
