Determining Jones Act Workers' Compensation for Maritime Accidents in Louisville

After work-related maritime accidents, one of the first questions injured divers often have is whether or not they qualify for Jones Act Workers' Compensation after their diving accident.

Many diving companies, in an effort to restrict injured divers to making claims only under the Longshore and Harbor Workers' Compensation Act, claim that divers assigned to different vessels owned by different proprietors are not Jones Act seamen, a ruling that was upheld in a court case in 1992.

However, since then, the issue has been revisited several times for further clarification by the U.S. Supreme Court, and now commercial divers are largely considered Jones Act seamen and are subject to all of the same rights and benefits therein. As with any legal matter, your rights and entitlements are better fortified when you enlist the services of an attorney who specializes in diving accidents.

If you have been injured in a diving accident or in any of the other kinds of maritime accidents that fall under the Jones Act, speak with an attorney who can help. With the assistance of an attorney, you can get the Jones Act Workers' Compensation benefits you are entitled to after a serious injury in the course of your employment.
